General Provisions
These Terms of Use apply to the barbacount.com domain, including all subdomains, web pages, and mobile applications (collectively, “BarbaCount”). The BarbaCount platform is owned by "BARBADOS" d.o.o. Sarajevo, KSC Jošanička br. 33.
A “User” is any person who accesses and/or uses BarbaCount services, including unregistered users, registered users, and business entities that use BarbaCount services under a contractual relationship.
User Registration
By accessing BarbaCount you accept these Terms of Use. We reserve the right to change, modify, or supplement these Terms at any time; changes take effect upon publication. By accessing BarbaCount you are deemed to be acquainted with the current Terms of Use.
To use certain services, you may need to register and provide personal and contact information. Data is collected solely for the purpose of providing BarbaCount services. The user warrants that submitted information is accurate and complete. BarbaCount will use and protect personal data in accordance with applicable data protection laws. BarbaCount services are available to persons aged 16 and over.
The user may request closure of their account and deletion of data at any time. Instructions will be sent to the user’s email address.
The user is responsible for safeguarding their password and should change it periodically. The user is fully responsible for any damage arising from unauthorized use of access rights and for all content submitted under their account. BarbaCount is not liable for password misuse but will act upon a reported incident.
What BarbaCount Is (and Is Not)
BarbaCount does not offer posting, viewing, or purchasing of ads and/or products. BarbaCount is a service platform that provides OCR (optical character recognition) processing and generates translation card reports based on OCR content.
Prohibited Use
BarbaCount may suspend or close accounts that violate these Terms. It is prohibited to upload or submit content that is unlawful, harmful, threatening, abusive, harassing, defamatory, or otherwise harmful to minors. Users must not upload content that infringes third-party copyrights, related rights, trademarks, trade secrets, or other intellectual property rights, nor may they upload malicious code or attempt to disrupt the service.
The user is solely responsible for any links or content they submit to BarbaCount. BarbaCount makes no warranties regarding the authenticity of user-submitted content. The user agrees to indemnify BarbaCount for damages arising from submission of prohibited content. BarbaCount will remove content it determines violates applicable law or these Terms.
Liability
BarbaCount reserves the right to determine the scope of intervention (including removal, blocking, or legal action) in cases of violations. In case of dispute, the competent court is in Sarajevo, Bosnia and Herzegovina.
Any disputes between users (including the accuracy of user data or any statements made by users) are resolved exclusively between those users. BarbaCount is not liable for damages arising from such relations.
Without BarbaCount’s prior consent, copying of any part of BarbaCount, especially user-provided data, is prohibited.
BarbaCount is not liable for damages that may result from service interruptions, non-publication or deletion of content, misuse of publicly available information, or any costs the user may incur by using the platform.
Using the Service (File Submission & Results)
Users may upload files solely for the purpose of OCR processing and generation of translation card reports. By uploading, the user confirms they have the necessary rights and lawful basis to process the file content and that the content is lawful and appropriate. The report must correspond to the uploaded file; do not upload unrelated images or placeholders.
Only one data set (file or logical set of files) may be submitted per processing request unless otherwise clearly indicated as a bundle. Titles, descriptions, and metadata must accurately describe the submitted content. BarbaCount may reject processing requests that are misleading, unlawful, or otherwise contrary to these Terms.
Payments
Paid services may be settled by supported credit/debit cards or bank transfer as provided during checkout. Funds credited to a user account (“credits”) may be used solely for BarbaCount services, are non-transferable, and do not expire. Where refunds are approved (e.g., duplicate charge or a failure attributable to BarbaCount), refunds are issued to the original payment method in accordance with applicable law and processor rules.
Data Processing & Retention
Uploaded source files are stored only for the duration of processing and are removed thereafter. OCR output content is retained for 7 days after processing and then removed from our systems. Retention is strictly for service delivery, troubleshooting, and limited operational analytics. For questions about data handling, contact: info@barbacount.com.
Electronic Communications
Support and system notifications are intended solely for service-related communications. To prevent misuse, BarbaCount may limit or disable messaging features without prior notice in case of suspected abuse.
Final Provisions
These Terms of Use apply and are effective as of 26.08.2025.
